北市廉政委員會針對大巨蛋案，建議移送總統馬英九、財政部前部長李述德，台北市長柯文哲15日出席北市國小模範生表揚大會時表示，他很強調程序正義，必須給當事人說明機會，但因馬總統有豁免權，因此與政風處討論後決定先請李述德來說明。

柯文哲說，昨天北市政風處有跟他報告此案，建議移送馬、李等，但他認為還是要給當事人陳述機會，因馬總統有豁免權，「所以結論是先從李述德開始」，政風處近日會擬提問問題。

此舉是否代表不會請馬總統來說明，甚至不會移送馬？柯文哲說「不是不是」，但並未明講具體期程。柯文哲說，「坦白講這滿難定案的，他說我笨啊、我能力不夠啊，你也奈何不了，滿難處理的！」還是交給專業，因為廉政委員會是在政風處底下，還是交給政風處完整處理後再定案。
